Terms of Service

1. Who these Terms apply to

• Creators — people or businesses who sign up for SuperKreator to build a link-in-bio, store, automation, publishing, LIVE, or related workspace.
• Buyers — people who browse or purchase from a creator's public store or product page. Buyers do not need a SuperKreator account.
• Visitors — anyone who views marketing pages, public creator pages, or other public parts of the Services.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Services

SuperKreator is a creator platform. Depending on your plan and settings, features may include:

• Public creator profile and link-in-bio pages (for example at https://superkreator.com/your-username)
• Online storefronts for digital and physical products, including catalog, cart, coupons, categories, orders, and customer leads
• Checkout and payment processing through our payment partner (currently Cashfree), typically in Indian Rupees (INR)
• Instant delivery of digital goods after successful payment, and order tools for creators to fulfill physical goods
• Social account connections (including Instagram and YouTube) for publishing, automation such as AutoDM, analytics, and related features
• Content planner, scheduling, and publishing tools
• YouTube LIVE streaming features, including scheduled slots and hour pools on eligible plans
• AI-assisted captions and copy tools powered by third-party model providers
• Storefront templates, theme customization, analytics, and referral programs
• Subscription plans (for example Free, Creator, and Live) and optional LIVE seat add-ons

Features may change, be limited by plan, invite access, waitlist, or third-party platform approval (for example Meta App Review for messaging features). We may add, modify, or discontinue features with reasonable notice where practical.

3. Accounts and eligibility

• You must be able to form a binding contract under applicable law to create a creator account.
• You may sign in with supported methods such as Google or email one-time codes. You are responsible for keeping account access secure.
• Access may be invite- or waitlist-gated. An invite or referral code does not guarantee ongoing access or a specific plan.
• You must provide accurate account and profile information, including a unique username that does not infringe others' rights or impersonate another person or brand.
• Workspaces may have members with different roles. The workspace owner is responsible for activity under that workspace.

4. Plans, billing, and taxes

Paid SuperKreator plans and add-ons (including Creator, Live, and LIVE seat upgrades) are billed through our payment partner. Prices, intro offers, feature limits, and GST treatment are shown at checkout or on our pricing pages and may change prospectively.

• Subscriptions renew for the selected billing period unless cancelled before renewal according to the tools or process we provide.
• Fees are generally non-refundable except where required by law or expressly stated by us.
• You authorize us and our payment partner to charge the payment method you provide for plan fees, add-ons, applicable taxes, and approved purchases (such as storefront templates).
• We do not store full card numbers on our servers; payment details are handled by the payment processor.
• Unless we expressly act as merchant of record for a specific product, creators are responsible for their own store pricing, invoices, GST/tax compliance, and customer communications for store sales.

5. Creator stores and products

Creators may list digital products (for example files or delivery links), physical products, and other product types we support. Creators are solely responsible for:

• Product descriptions, pricing, licensing terms, delivery files or URLs, shipping practices, and fulfillment timelines
• Obtaining rights to sell the products and media they upload
• Complying with consumer, tax, advertising, and product laws that apply to their offers
• Their store's Privacy, Terms of Sale, Refunds, and Contact pages (defaults we provide are templates; creators should review and customize them)

Digital purchases are typically delivered automatically after successful payment. Physical orders collect shipping details for the creator to fulfill; SuperKreator does not operate courier logistics unless we expressly state otherwise.

SuperKreator provides software and payment routing tools. Except where we sell our own plans or templates, we are not the seller of creator store products and are not a party to the sale contract between creator and buyer.

6. Buyers and store purchases

• When you buy from a creator store, you buy from that creator under that store's terms, refunds policy, and privacy notice, in addition to these platform Terms where they apply.
• Payments are processed by Cashfree or another processor we designate. Successful payment is required before digital delivery or order confirmation.
• Digital goods may be licensed for personal use only unless the creator states otherwise. You may not redistribute, resell, or share delivery links without permission.
• Refund and support requests for store products should go to the creator first, using the store contact or refunds page. Platform support may help with technical checkout issues but cannot guarantee a refund from a creator.

7. Content and intellectual property

You retain ownership of content you submit (profiles, links, store themes, products, media, messages, LIVE content, and similar "User Content"). You grant Graphity Technology Private Limited a worldwide, non-exclusive, royalty-free license to host, store, display, transmit, and otherwise use User Content solely to operate, improve, promote, and secure the Services (including public pages you choose to publish).

The SuperKreator name, logos, software, default templates, and platform design are owned by us or our licensors. You may not copy or reverse engineer the Services except as allowed by law.

You represent that your User Content and products do not infringe others' rights and are not unlawful, deceptive, or harmful. We may remove content or suspend accounts that violate these Terms or applicable law.

8. Acceptable use

You agree not to:

• Use the Services for fraud, money laundering, illegal goods, or prohibited content
• Spam, scrape, or abuse messaging, AutoDM, comments, email, or other automation in ways that violate Meta, YouTube, or other platform rules
• Upload malware, attempt unauthorized access, or interfere with the Services
• Impersonate others, misrepresent affiliations, or use usernames to phishing or deceive buyers
• Circumvent plan limits, delivery protections, payment flows, or access controls
• Sell or promote content that infringes IP, privacy, or publicity rights

9. Third-party platforms and AI

Features that connect to Instagram, Meta, YouTube, Google, Cashfree, cloud storage, AI model providers, or other third parties are subject to those providers' terms and policies. Your continued use of a connected feature requires that you remain in compliance with them.

• We may receive limited social account data you authorize (for example identifiers, username, and profile metadata) as described in our Privacy Policy.
• Platform bans, API changes, rate limits, or App Review decisions may reduce or disable features; we are not liable for interruptions caused by third-party platforms.
• AI tools may send prompts and related context to third-party model providers to generate suggestions. AI output may be inaccurate; you are responsible for reviewing it before publishing or selling.
• LIVE streaming must comply with YouTube policies and our hour, seat, and slot limits. Looping or automated LIVE content remains your responsibility.

10. Referrals

If you participate in Refer & Earn, commissions are calculated on eligible referred creators' plan charges under the rates and rules shown in the dashboard at the time. We may withhold, adjust, or reverse commissions for fraud, refunds, chargebacks, or policy abuse, and we may change referral terms prospectively.

11. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted availability, specific earnings, delivery by creators, or that AI or automation features will achieve any particular result.

12. Limitation of liability

To the fullest extent permitted by law, Graphity Technology Private Limited and its directors, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Services or any creator–buyer transaction.

Our aggregate liability for claims relating to the Services will not exceed the greater of (a) the amounts you paid us for the Services in the three months before the claim or (b) INR 5,000, except where liability cannot be limited under applicable law.

13. Indemnity

You agree to indemnify and hold harmless Graphity Technology Private Limited from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, products, store policies, misuse of the Services, or violation of these Terms or third-party platform rules.

14. Suspension and termination

You may stop using the Services at any time. To delete a creator account, contact [email protected] as described in our Privacy Policy. We may suspend or terminate access if you violate these Terms, create risk for users or platforms, fail to pay fees, or if we discontinue the Services. Provisions that by nature should survive (including IP, disclaimers, limitations, and indemnity) will survive termination.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will change when we do. Continued use of the Services after an update constitutes acceptance of the revised Terms, except where additional consent is required by law.

16. Governing law

These Terms are governed by the laws of India. Courts in Faridabad, Haryana, India will have exclusive jurisdiction, subject to any non-waivable consumer protections that apply to you.
